Robert W. Carpenter has represented clients in many complex family law matters for over 30 years in Boston and surrounding counties.

Attorney Carpenter is a member of the American Bar Association and is a Discovery Master in the Massachusetts Probate and Family Court. Robert W. A licensed Massachusetts attorney since 1985, Attorney Carpenter’s practice focuses on divorce and family law litigation, including custody, visitation, grandparents’ rights and visitation, paternity, uncontested divorces, removal matters, child support, restraining orders, property valuation and division, alimony, alimony reform, divorce and custody modifications, contempt matters, and appeals. Attorney Carpenter can also skillfully represent you in a restraining order defense, or help you navigate through the difficult path of domestic violence. Attorney Carpenter also represents family-based immigration clients who are seeking family sponsored permanent residency (green cards) through marriage or relationship with a Citizen, removal of conditions, K-1 and K-3 visas, V visas, Citizenship applications, Permanent Residency renewals, Employment Authorization, Adjustment of Status and Consular Processing, hardship waivers, waivers of inadmissibility, VAWA based petitions with the USCIS, and Removal and Asylum cases before the US Immigration Court in Boston.

Child Custody and Visitation


Parents may ask the Courts to order a visitation or parenting plan if the parents cannot agree. Both mother and father will be considered to have custody and a plan will be implemented that is in the best interests of the child. Some parents see and take their children only every other weekend, while some split weeks. Some parents must have supervised visits. Existing parenting plans can be altered through a modification if there have been substantial changes in circumstance. Attorney Carpenter is well practiced and has successfully pursued modifications. Child support is set by guidelines issued by the Commonwealth of Massachusetts and an order will be set according to the Financial Statements of the parties, which detail each parties income, assets, and debts. Failure to pay ordered child support can result in penalties, loss of driver’s license, and incarceration. Unless not in the best interest of the child, both parents will have access to the child, the child should live in a healthy environment, and the child should not be exposed to parental arguments. Legal custody may be sole or joint, depending upon the parents’ ability to get along, and physical custody also can be shared or sole. Attorney Carpenter will work with you to present yourself in the most favorable light to the Court.

Parents may not move with their children from Massachusetts without the consent of the other parent or by filing a removal petition with the court. Parents who have moved without permission have been ordered to return their children back to the Commonwealth of Massachusetts. If you want to move from the Commonwealth with your child Attorney Carpenter will advise you through the difficult process.

Family Law and Divorce


If the parties agree, Attorney Carpenter will draft a divorce agreement for review by the Probate and Family Court judge. An uncontested divorce is final 120 days after the court hearing. A contested divorce is assigned a track and may take between 8 to 12 months or more depending upon the issues. Attorney Carpenter will use many tools such as depositions and discovery to guide you through temporary orders of custody, parenting plan (visitation) and child support as appropriate and conduct thorough investigations of your spouse’s assets, including income, investments, business, real estate and retirement accounts, and analyze them for division. Debts can also be divided. If custody is an issue, often the court will assign a Guardian ad Litem to interview the children and make recommendations as to a parenting plan. Attorney Carpenter will guide you through the GAL process so that your point of view is considered by the GAL and by the Judge. If an agreement cannot be reached after discovery and the GAL process, the Divorce matter will go to Trial. An experienced litigator, Attorney Carpenter will compile witnesses, exhibits and prepare your testimony for the best result possible.
